exactly. GPL-based code that's not redistributed does
not have to be made public (the GPL does not force you
to make your code public--as Adam notes it just
determined the terms under which you can distribute). 

Once the code is distributed, it must be made
available under the GPL. There is no GPL violation in
the ransom/advance model so long as once the code is
distributed, it's distributed under the GPL.
